Agreement to Terms
By accessing or using our website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
Our Services
Control Shift provides professional web development, app development, and digital services including:

- •Ongoing maintenance and support
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.
Project Terms & Deliverables
Project Scope
Each project begins with a detailed proposal outlining the scope, timeline, and deliverables. Any changes to the agreed scope may result in additional charges and timeline adjustments.
Timeline
We strive to meet all agreed-upon deadlines. However, timelines may be affected by client feedback delays, scope changes, or unforeseen technical challenges. We will communicate any delays promptly.
Client Responsibilities
Clients are responsible for providing necessary content, feedback, and approvals in a timely manner. Delays in client responses may impact project timelines.
Payment Terms
- •Deposits: A deposit is required before work begins on any project
- •Payment Schedule: Payment terms will be outlined in your project proposal
- •Final Payment: Full payment must be received before final project delivery
- •Late Payments: Overdue payments may result in project suspension
- •Refunds: Deposits are non-refundable once work has commenced
Intellectual Property & Ownership
Upon receipt of full payment, you will own the custom code and design elements created specifically for your project.
Third-Party Assets: Any third-party themes, plugins, stock photos, or other assets remain the property of their respective owners and are subject to their licensing terms.
Portfolio Rights: We reserve the right to display completed projects in our portfolio and marketing materials unless otherwise agreed in writing.
Warranties & Limitations
We warrant that our services will be performed with reasonable skill and care. However:
- •We cannot guarantee specific search engine rankings or traffic levels
- •We are not responsible for third-party service disruptions
- •Website performance may vary based on hosting, traffic, and other external factors
- •We are not liable for damages arising from the use of our services beyond the project cost
Support & Maintenance
Post-launch support terms:
- •Bug Fixes: We provide bug fixes for 30 days after project completion at no additional cost
- •Ongoing Support: Ongoing maintenance and support packages are available separately
- •New Features: Any new features or functionality beyond the original scope will be quoted separately
Termination
Either party may terminate a project agreement:
- •We reserve the right to terminate projects if payment terms are not met
- •Clients may terminate projects with written notice, but deposits and work completed to date are non-refundable
- •Upon termination, we will deliver all completed work upon receipt of payment for services rendered
Confidentiality
We respect the confidential nature of your business information. Any sensitive information shared during the project will be kept confidential and will not be disclosed to third parties without your consent, except as required by law.
Limitation of Liability
To the maximum extent permitted by law, Control Shift shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for the specific service in question.
Governing Law
These terms are governed by the laws of Tasmania, Australia. Any disputes shall be resolved in the courts of Tasmania.
Changes to These Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
